U.S. Attorney Patrick J. Fitzgerald was ranked among prosecutors who had "not distinguished themselves" on a Justice Department chart sent to the White House in March 2005, when he was in the midst of leading the CIA leak investigation that resulted in the perjury conviction of a vice presidential aide, administration officials said yesterday.

The chart was the first step in an effort to identify U.S. attorneys who should be removed. Two prosecutors who received the same ranking as Fitzgerald were later fired, documents show.

The March 2005 chart ranking Fitzgerald and other prosecutors was drawn up by Gonzales aide D. Kyle Sampson and sent to then-White House counsel Harriet Miers. The reference to Fitzgerald is in a portion of the memo that Justice has refused to turn over to Congress, officials told The Washington Post, speaking on the condition of anonymity because Fitzgerald's ranking has not been made public.
"Routine personnel matter." Move along. Nothing to see here. But P.S. -- We refuse to turn that portion of the document over to you.

Makes you wonder how Fitzgerald got the U.S. Attorney gig in Chicago, though. Doesn't it?

Here's how.

[Republican] Sen. Peter Fitzgerald (no relation) was looking for an outsider to battle the state's notoriously corrupt political apparatus.

The recently retired Illinois Republican tells a story about back in Al Capone's day, when Col. Robert McCormick, the imperious publisher of the Chicago Tribune, called FBI Director J. Edgar Hoover and demanded that he send someone to Chicago who could not be bought.

Hoover sent the untouchable Eliot Ness.

Now, as then, the U.S. attorney's job has the gloss of patronage. The late Chicago mayor Richard J. Daley used to say the U.S. attorney in Chicago is one of the three most important people in the state, and Peter Fitzgerald said he wanted "someone who couldn't be influenced either to prosecute someone unfairly or protect someone from being prosecuted unjustly."
Uh-oh! Is there any more obvious red flag for the Bushies?

But I guess that wasn't yet clear to Senator Fitzgerald:

So the senator, who as the state's senior Republican had the right to recommend a candidate to the White House, went to one of Hoover's successors for advice.

"I called Louis Freeh and said, 'Who's the best assistant U.S. attorney you know of in the country?' He said, 'Patrick Fitzgerald in the Southern District of New York.' " The senator then called Mary Jo White, who ran the New York office. Same question. Same answer.
And what does Mary Jo White say this ranking tells us today?

Mary Jo White, who supervised Fitzgerald when she served as the U.S. attorney in Manhattan and who has criticized the firings, said ranking him as a middling prosecutor "lacks total credibility across the board."

"He is probably the best prosecutor in the nation -- certainly one of them," said White, who worked in the Clinton and Bush administrations. "It casts total doubt on the whole process. It's kind of the icing on the cake."
The Bush "administration" continues to facilitate its own escape, by destroying the credibility of the Department of Justice that would otherwise one day pursue them as they slink out the back door with half the Treasury in their pockets in January 2009.

GOP Braces For Testimony Fight, Likely Gonzales Exit - Politico.com

House and Senate Democrats vowed to continue pursuing their investigation of December's U.S. attorney purge, and they dismissed Monday night's document dump by the Justice Department as woefully inadequate.

Senate Judiciary Committee Chairman Patrick Leahy (D-Vt.) suggested on Tuesday that even more U.S. attorneys may have been fired than the eight that have been publicly acknowledged by the White House or Justice Department, although the Vermont Democrat was not able to offer any more information publicly than redacted e-mails between senior administration officials where the names of some prosecutors have been blanked out.

Leahy will seek authority on Thursday from his panel to issue subpoenas to Rove and Harriet Miers, the former White House counsel. "Frankly, I would hope the administration would cooperate with us, but if they don't, we will subpoena," Leahy told reporters, repeating a threat that he has made frequently in the past two weeks.

In DOJ documents that were publicly posted by the House Judiciary Committee, there is a gap from mid-November to early December in e-mails and other memos, which was a critical period as the White House and Justice Department reviewed, then approved, which U.S. attorneys would be fired while also developing a political and communications strategy for countering any fallout from the firings.

Sen. Dianne Feinstein (D-Calif.), a member of the Judiciary panel, noted that six of the eight fired prosecutors were involved in corruption investigations focusing on GOP lawmakers or officials, and she questioned whether the firings were an effort by Republicans to protect their own.

After fighting off GOP attempts to alter the bill, Senate Democrats on Tuesday pushed through legislation that would revise the Patriot Act so that Gonzales or his successor does not have the power to unilaterally appoint U.S. attorneys without Senate confirmation. The legislation, sponsored by Feinstein, passed by a 94-2 margin, with only Sens. Chuck Hagel (R-Neb.) and Kit Bond (R-Mo.) voting against the bill.

Clinton's political maneuvers actually involved a crime in the first place. Firing judges is not a crime and as of now there is no proof that a crime was committed that I'm aware of.

True, however the "crime" (perjury about him getting oral sex) came after an extensive multi-year investigation that cost tens of millions of dollars. This included many WH personnel being subpoenaed to testify, memos and files confiscated, and the only crime was a married man lying about committing adultry, something that half the married population engages in at least once.

If those same kinds of resources were focused on the current administration and practices over the past six years, I'm scared to think what would be found.

yeah because people didn't hate clinton until the stained dress in 98...from 93-97 he was loved by all

And again the "evidence" he committed a crime is pretty close to nill

Gonzales was sworn in the other day and he may have lied to Congress, the WH is hiding emails, and uncovered information shows he ordered the firings

Which all came about based on numerous sexual harassment claims/charges and solid evidence (tape recordings) that he had previously lied in order to get out of it.

all that existed prior to his presidency....it was a witch hunt, and looking back it's very obvious.
