Authorities: Fifth-graders posted lookout, had sex in class

NEW ORLEANS, Louisiana (AP) -- Five fifth-grade students face criminal charges after authorities said four of them had sex in front of other students in an unsupervised classroom and kept a classmate posted as a lookout for teachers.

The students were arrested Tuesday at the Spearsville school in rural north Louisiana, authorities said. Two 11-year-old girls, a 12-year-old boy and a 13-year old boy were charged with obscenity, a felony. An 11-year-old boy, the alleged lookout, was charged with being an accessory.

"After 44 years of doing this work, nothing shocks me anymore," said Union Parish Sheriff Bob Buckley. "But this comes pretty close."

Authorities said the incident happened March 27 at the school, which houses students from kindergarten through 12th grade. A high school teacher normally watches the fifth-grade class at the time, but went to an assembly for older students and the class was inadvertently left unattended, Buckley said. The class, which had around 10 other students, was alone for about 15 minutes, he said.

"When no teacher showed up, the four began to have sex in the classroom with the other elementary students in the classroom with them," he said.

It took a day for authorities to find out about the incident. A student who had been in the class told a high school student about it the next day, Buckley said. The student told a teacher, and school officials notified the sheriff's office. Detectives began questioning students Thursday.
School officials did not return calls seeking comment.

The students, who were not identified because of their age, were released to their parents after their arrests, Buckley said. They will next be arraigned in juvenile court.

A message seeking comment from the district attorney was not immediately returned.

Buckley said it was unclear what penalties the children could face.

I don't understand why they're being charged with a felony

I know at that age they can't legally consent, but as long as it was obviously not forced, charging them with a crime instead of educating them seems strange to me.

What the hell?

They're being charged with felonies? If nothing was forced its a bunch of kids experimenting, charging them with felonies is insane. There was obviously a massive failure on the part of the parents. Also, how'd they get into an unsupervised classroom?

Man, I should keep a logbook on Why To Dismantle Government Education. I mean, really, when's the last time this happened in a Wal-Mart, a Taco Bell, or a private school? No private institution seems to have this magnitude of problems.

being charged with a felony is ridiculous. At most it's public indecency as far as the law is concerned. As a parent or a school official I would be MUCH more concerned with how the hell these kids got to this point in the first place.

Have sex in front of a minor should be a felony. But how can you charge a minor with that? I don't get it.

a minor having sex infront of a minor is not though. don't you have to be an adult to be charged with a felony???

I agree with most in the thread that charging them with legal stuff is a bit absurd.

This is a massive parental problem. Some fault does fall on the school for leaving a room unlocked with no supervision for an extended period. They may have some legal issues as parents of the students who were watching could take the school to court and try to hold them liable.

As far as those who were making a public sexytime, they should be expelled for the year and forced to attend different schools if they want to continue to attend public school after the expulsion is over.

A little perspective?

We live in times where kids take guns to school and massacre each other. They do hard drugs at school. They bully other kids to the point of having psychological damage. Etc, etc...

I can think of a whole lot worse stuff for kids to be exposed to than a consensual orgy.

If that's the worst thing a kid has to experience in school, he should be considered lucky. Then again, I never bought that sex is a dirty thing that can hurt kids (as long as it's consentual and not adult on kid sex), so maybe that's why I don't find it outrageous.

Of course there are worse things. That doesn't mean this wasn't bad and WRONG.

Having sex in public is a criminal offense. I don't understand why people are shocked they got charged with that crime. They were 11-13 and obviously knew what they were doing was very wrong. Let them learn their lesson. I don't think they should be listed as sex offenders for life though because of this. Let them go before a judge, get scolded and do a little community service. When they're 18 it should be wiped from their record.
