No, you shouldn't. You should only get in trouble if you actually hurt me. If you're doing it and I feel like I'm in danger, it's quite likely that I'm going to probably attack you. The law should consider the danger in that case, as well. I was cornered into a dangerous position, by you, and then I retaliated as a means of opting out of that position. I like to call this "self defense."

Wow this got a lot of responses all the sudden.

We were bar hopping most of the evening and when we went to the last bar I decided not to drink anymore so that I could drive home. I thought I was sober enough at the time. In retrospect I don't really think I was and this experience will change how I evaluate that kind of decision in the future. Namely that anytime I drink more than 1 or 2 beers across the course of the night I will not drive no matter how I feel. I wasn't given a breathalizer, I probably wouldn't have passed.

I went through a hefty process with the cops (he had his gun on me to begin with, followed by a call for backup, handcuffs, weapon searches and car searches), but I remained collected and cooperative. If I had to guess I probably did fairly well with the sobriety tests, so after talking with me for a while I think they decided to give me a break and let me walk home scared shitless with a speeding ticket.

I am not saying all this to justify anything, but I thought I would give a fuller story.

As for the speeding thing, it's dumb to speed after drinking for more reasons than one. The particular road was pretty much a four lane free way that I go that fast on all the time.

Your argument makes no sense....... he can drive drunk and as long as he doesn't hit anyone he's ok, but if I fire bullets I should get in trouble even if I don't hit anyone.

I'm surprised that he did this, more for the liability than anything else.

The cop assumed responsibility for you when he removed you from your car and let you walk. If you stumbled off the sidewalk or even if you were just walking on the side of the road and got hit by a car, that cop would have gone to jail. That was stupid on his part.

Utterly ridiculous....... I can walk out of my house, fire off a few rounds past your nose, and go back inside and not expect you'll call the police. If you get a gun and come after me I can justify killing you because (a) I didn't hurt you and (b) you're going to attack me. So that means essentially you have to allow me to fire a few shots at you every so often and you can only retaliate if you catch me in the act.

But then again the best part is after I do it 3 or 4 times I can claim precedent (for not wanting to injure you) and if you retaliate while I'm shooting then I can justifiably shoot you dead. I mean, I wasn't going to hit you and I already proved that. So when you fired at me I had every reason to expect you were trying to kill me.....but you can't make the same claim!!

That's the logical end to your stupid position that "it should not be illegal to shoot at someone."
