true. and that's not even mentioning the fact that the legal system has an inherant bias towards females when it comes to custody. As long as she isn't a drug addict, has a job and can support and care for the children she will get them. In order for a husband to get custody from his ex-wife she'd pretty much have to be a hooker or legally insane or something equally egregious. ( did I spell that right?)

Question: is his name on the cell phone account that she is using? If so, he could definitely have legally requested the information from the provider considering that the account is in his name (in part or in full), and they would be obligated to comply.

AT&T did voluntarily hand over reams of information to NSA not so long ago. I wouldn't ever send anything whose secrecy mattered over a phone without encrypting it.

According to Sprint PCA legal services, they don't save text information...it's too much data, and text messages can never be retrieved. Only numbers...
