taking DNA at traffic stops

http://www.local6.com/news/15232197/detail.html

Police officers in Daytona Beach are swabbing the mouths of persons of interests during traffic stops with special DNA kits in the hunt for an elusive serial killer, sources close to the investigation told Local 6.

A profiler said the serial killer is likely clean cut and probably has a wife or girlfriend.

And, the Daytona Beach police Chief, Mike Chitwood, said detectives have the killer's DNA.

"Genetically, we know who he is," Chitwood said. "We have DNA evidence from the murder scenes -- so, we got that. That is never going to go away. And, sooner or later, we will match the DNA to the physical person and bring closure to everything that is going on."

Are guys allowed to refuse? The article doesn't say. I know I didn't kill anyone, but I also know I wouldn't let them take my DNA. So if guys are allowed to refuse then how are they "working really, really hard"? And if they're not, WHAT THE FUCK!!!

DNA Collection Controversy In Serial Killer Search - Central Florida News 13

But Chitwood said his officers are not randomly stopping people to get that evidence, and that they have consent or a warrant.
so they're wasting time and effort, then

You need a court order to obtain a DNA sample from a suspect afaik

Of course, that doesn't prevent them from asking people to willingly submit to a DNA test.

that's why I say they're wasting time, but then again, from the 2nd link
Chitwood said all the DNA evidence is sent to an FDLE database.
so they're taking DNA and telling people it's to find the serial killer, but they're sending all the samples to the Florida Department of Law Enforcement DNA database for future use

they're not just comparing the DNA they take with the killer's DNA....they're saving it for the future.

Florida Department of Law Enforcement are complete fucking assholes for this.

Alot of people these days readily and willingly give up thier rights for what they think provides them security. It's pretty sad.

step 1) scare people. OMG there is a serial killer on the loose!

step 2) convince them that some action is necesary, and it requires them giving up thier rights.

step 3) Convince them that if they give up these rights that they will be safer.

That's all it takes for 90% of the general population to open wide for a random DNA test.

Because they "didn't do anything wrong", cops are armed, and cops are in control of the situation.

You are basically being forced to do it by intimidation

I honestly think it takes even less. I think most people would do it just because a cop asked.

no, you're doing it because of your own ignorance........they have the right to ask for anything. You have the right to refuse. If you don't want to but do it anyway it's nobody's fault but yours.

In some cases maybe. But if you were just stopped randomly by a cop and were asked to submit to a DNA test and provide ID for no good reason, I think alot of people would refuse..

But if the cop approaches you and says " hey there is a serial killer on the loose" they have succeeded in step 1. They scare you. Then they ask you to submit to the test to help them catch the killer. That's steps 2 and 3.

Some of you might know that Philly has a bit of a crime problem. and by that I mean it has the nickname Kill-a-delphia.
So they are going to be implementing a random stop and frisk policy in some high crime areas. Most people want it. They say that it's a good idea. They don't care if they have to give up thier rights. They are already scared and they think this will make them safer.

we all know a majority of america has been conditioned to do whatever a cop asks, right or wrong. people aren't taught their rights in school.

I've been stopped and had a cop say "a store near here was robbed and you sort of fit the description. Can I see your ID?" I said sure and gave it to him. He asked a few questions, like he was beating around the bush, then said "do you have any tattoos?" and I laughed and said no. Then he told me the clerk saw a tattoo on the guy's hand and he thanked me and left. If he asked me for DNA I would have said no. If he asked something like "can I see your back" or something, looking for a tattoo, I would have said no. I guess we all have our limits.

But if the cop approaches you and says " hey there is a serial killer on the loose" they have succeeded in step 1. They scare you. Then they ask you to submit to the test to help them catch the killer. That's steps 2 and 3.
But if I'm not the killer, how is taking my DNA going to help catch the killer? That's the disconnect.

If they asked me to submit to the test to catch the killer, I would LOL and ask them if they think the serial killer is going to voluntarily give up his DNA.

Then curl up in a ball and whimper "don't taze me bro "

I disagree because it involves putting something in a man's mouth, that is much more personally invasive than fingerprinting
