guy isnt a sexual predator. he's not a pedophile going around scoping out the preteens. he was tricked by a whorish 13 year old who looks older than she is, and who got exactly what she wanted.

so yea, send the guy to jail... and maybe we can send a 3rd guy to prison since she's still going to be staying out late, having not learned a damn thing at all.

why can't there be a hearing to figure that out?

Known better than what?

You keep talking like this guy should have known she was 13, when she lied about her age and certainly doesn't look like what I remember the typical 13 year old girl looking like

She's allowed to stay out late, unsupervised, hang out at bars (see the picture I posted), how is this guy supposed to discern her age when every indication is that she's of legal age?

How is he supposed to know? Hire Miss Cleo?

Oh wait, he did.

I guess "To protect and serve" is all just a bunch of bunk. I don't think Americans would very much like the idea that our government and criminal justice system isn't supposed to be used to protect people... In any event, that's not the way our justice system is set up and it likely won't be any time soon.

I know she didn't get pregnant, but she could have. And yes, she should know better, but she's 13. She's a child. I'm sure this isn't going to be the last time she lies about her age or something similar. I think his punishment was too harsh, but I think he needs to get something for having sex with a minor or else any guy can go around having sex with children who lied about their age.

Having casual sex with thirteen year old children is though... regardless if they said they were older.

Uh, why should he be punished at all? If girls lie about their age, why should someone who has sex with them be punished for the girls deception?

Like Jimeigh said earlier in the thread, it's like a law saying you can't sleep with blondes, one dyes their hair, says they're a natural brunette, but you find out later they were lying about it, and so you get sent to jail

There's no justice there, the man here is the victim of a deceitful girl who sleeps around with older men and piss poor parenting.

The difference is this is a child and doesn't have something to do with someone's hair color. Children are going to lie about things. A better example would be the fact that you can't engage into a contract with a minor, even if they lie about their age. If you asked them their age and they lied, you're fucked. If you asked a minor their age and they lied, then you proceeded to have the sexy time, you're fucked (pun intended).

Uh, obviously it's not about hair color, but the analogy fits perfectly. You can't always tell someone's age by their looks, and if the person lies to you about it, you shouldn't be held responsible.

You're trying an appeal to emotion based on the age of the liar.

It only makes the contract null and void, it doesn't take away your freedom by placing you in jail and forcing you to register as a sex offender, having to live with the label for the rest of your life

what does this have to do with anything? i mean first of all, i'm pretty sure the girl was aware of the possibility. and since she isnt pregant, i'm gonna go ahead and say that, since she's done this (at least) twice, she's made sure there was a condom involved, or maybe a pill, or both, etc. for all we know they were as careful as humanly possible to avoid pregnancy, because apparently, she isn't pregnant.
this argument "she could have gotten pregnant" is so besides the point that it's ridiculous. any person having sex might be responsible for an unwanted pregnancy. so what's your point, really? this is the total epitome of a non-issue, what you're raising right here.

And yes, she should know better, but she's 13. She's a child.
she's 13.... and she's having sex. on purpose. she lies about her age and does it well so she can get what she wants. she knows what she's doing. she's done it at least twice. and both times the other person involved with the sexing has gone to jail, while she got to stay out past 12 the next night on the corner, probably.

but oooh she's a blond, we should expect her to be so ditsy and stupid as to dye her hair and tell people she's a natural brunette. now, SHAME on the boy for falling for that trick! he should have known better. throw him in prison to make an example of him, that sex with blonds is wrong!

I'm sure this isn't going to be the last time she lies about her age or something similar.
so you're sure that there may be a 3rd or 4th dude getting sent off to prison while this little lolita continues to lure in the johns with lies of legality unpunished? that sits well with you, does it?

I think his punishment was too harsh, but I think he needs to get something for having sex with a minor or else any guy can go around having sex with children who lied about their age.
yes, give him a slap on the wrist for being so cleverly fooled.

the reason for these laws anyway, im pretty sure, is to punish those who take advantage of children.

and here, this child has taken advantage of two adults.

I have thought about this for awhile and I think I am ready to weigh in on it:

She is a liar and 5 years in prison is excessive. However, I don't care how physically developed a girl is within 15 minutes I can tell how old she is. I see 5 years probation without registering as a sex offender as the proper punishment, it is more than a slap on the wrist and hopefully a wake up call.

Her father needs to reevaluate his parenting actions and this girl needs some help if the parents are unwilling to offer it. I could see CPS stepping in her, even more than the religious case in Texas.

It takes away your property. One is civil behavior and the other is criminal behavior. And again, in this instance I'm not advocating taking away his freedom, but I don't think he should go unpunished. I believe the laws are too strict and should leave room for individual circumstances, but that doesn't mean I think it should be legal to have sex with a thirteen year old because she lied to you.

I think you need to meet her before you claim that you can tell how old someone is, honestly.
