Easy.

Change the law from 'statutory rape is defined as any sexual activity between a person greater than or equal to 21 years of age' to 'statutory rape is defined as any sexual activity between a person greater than or equal to 21 years of age. The preceding does not apply if:
a) The minor in question misrepresented their age as a legal age'

Then, add another law:

It shall be a misdemeanor to misrepresent your age in order to engage in sexual conduct with any person, provided that you are legally unable to engage in sexual conduct with them otherwise. This is punishable by not more than 30 days in jail with a year of counseling sessions to follow. PS Try not to suck any dicks on your way to the jail

have a hearing to see if she should be responsible.

again, if a 13 year old is responsible enough to be tried as an adult then go through the same process to figure it out in this case.
