Sorry to bring and old thread up but I was surfing around the net and ran across this post that fits a situation with a friend and what he's going through now.

He is siting in jail facing prison time for sexual assualt on a minor. He had sex with a 14 year old that lied about her age. She said she was 18.

Someone said, in this thread, to talk to the girls friends and people she went to school with to check her age. This girl said she was 18 right in font of her cousin, my friend made a comment about her not looking 18 and the cousin said she was 18.

Now here is the real kick in the head.My friend talked to this girl's MOM and she said her daughter was 18.

So I guess the arguement that talking to her friends and family can be thrown out the window as a precaution!

I remember in the law class I took my teacher mentioning that if a reasonable person would think that a girl looks of age, and said girl lies about her age to get sex from someone who is over 18, then the guy can't get in trouble. The problem is that if this comes before a jury, everyone on there has heard tell that the guy should have asked for i.d, or asked her friends about her age, etc. , and so they'll convict the guy even though he did nothing wrong.

I think women need to stop complaining about sexism. Men get discriminated against in a sexist way every day. How often to men get awarded custody in divorces? almost never. yes it happens, but there is a built in prejudiced against men in the legal system. men pay more for auto insurance just because they are men. Then there is this statutory rape thing.

And I'm pretty sure the judge from the first post knows what he's talking about. This girl lied and said she was 18, told people she was 18, had a myspace page that said she was 18, and HAD DONE THIS BEFORE and this guy still went to jail.

I guess UCMJ and civilian law are different, because what you said isn't represented by this case.

Even though everyone will agree with your point, it doesn't change the law. Statutory rape is a HUGE deal to people, so much so that this sort of shit happens fairly often.

Of course, what you describe is also entrapment. There's no such thing as entrapment (law-wise) between civilians.

Don't get me wrong, I agree with you! Stat rape laws are ridiculous. And people are so retarded about them, people can have their entire careers ruined at a simple accusation, even if untrue!

I'm not here to offer a solution... I'm just pointing out why a reasonable solution is unlikely to ever fix these laws which are based on unreasonable emotions.

Birth certs don't have pics. She could show something off a Xerox machine. Guy would still get convicted.

I'm amazed at the way "sexual" crimes have come to be treated. Just last week, a local school was placed on lock-down because some convicted sex offender was on the loose and police were looking to arrest him (probation violation, I think). Not that the school shouldn't have been on lock-down, necessarily, but... if the guy was a bank robber, murderer, arsonist, or name-your-crime, the school wouldn't have been on lock-down. The only reason it was, was because the guy was a "convicted sex offender".

We've begun focusing too much on the sex aspect (which is wierd, considering the continuing "liberalization" of the country) and not paying attention to who is committing the conscious bad act.
