13 year old lies about her age, sends second man to jail after they have sex


ORANGE COUNTy, Fla. -- A 13-year-old girl's sexual shenanigans have put a second man behind bars. Morris Williams, 22, told the judge he thought the girl was 18-years-old, but he found out Tuesday that ignorance is not a defense.

Morris Williams' mother wailed as he went off to jail. The judge asked for media not to show 13-year-old Alisha Dean's face in court, but her pictures are all over her MySpace page and they portray a sexy, 19-year-old divorced woman.

"She told me she had just turned 18," Williams said.

Williams said Dean picked him up on the street and after a few conversations they had sex. When he heard she was not 18, he went to her father.

"He was like 'well, she's 13,'" Williams said of a conversation with Dean's father.

Williams said he never did it again, but Dean has done it before with 24-year-old Darwin Mills. Mills was sentenced to five years in prison.

Dean's father wanted Williams to join Mills there.

"One of the reasons for the law is the fact that minors have poor judgment," said Jerry Dean, the girl's father.

Williams' father believes the jail sentence sends the wrong message to Alisha.

"I guess we just sit back and count how many after this," Henry Smith asked after his step-son was sentenced to jail.

Dean's family admits Alisha still stays out late and has yet to delete her misleading MySpace page.

Williams will serve six years probation with the first year in jail. The other five years he will have to wear an ankle monitor. His attorney says he will come back to court to ask again for a shorter sentence.

How fucked up is this? I can't believe it. This thread could also be titled "Why statutory rape laws are bullshit."

The girl lies about her age, they have proof she portrayed herself as older than she is, and still the guy goes to jail after doing the right thing and talking to the father after he finds out the truth?

This certainly isn't justice.. and look at that sentence toward the bottom of the article. The father still lets her have a myspace, and still lets her stay out late?

What a shitty parent, he's the reason the situation like this happened in the first place, not keeping track of his slut daughter's activities.. if anyone should be punished, it shouldn't be the guy who was deceived.

Isn't it time we just got rid of Florida? I mean, they fucked up 2000 something horrible, and now this.

Thats a case of a unfair law that sets an example by letting everyone know what will happen if they are not very very careful. He has to take the punishment and he does not deserve it, but it leaves a message to everyone else. Stay away from easy crazy girls.

so he found her in a place that is only supposed to have certain-aged people there, she said she was of that age, he asked and she said she was that age and gave bits of evidence to corroborate it.............was he supposed to ask for a birth certificate?

It's complete bullshit, laws shouldn't be there to "set an example" -- it should be about getting justice for the victim and punishing those who violate their rights

In this case, he was purposely mislead into believing he was getting involved with someone of legal age

I think the law is good policy. If you're going to mess with young girls, you best be sure they are of legal age.

As the article states, the goal is to protect young girls who cannot protect themselves. Kids make stupid decisions, including lying about their age.

If we make ignorance, or even lies by the victim a defense, the victim is going to become a witness in every case, and that victim is often going to be influenced either by threats or feelings for the older person.

This is an extreme case, and I sympathize with the guy, but it's pretty much the law in every state that if you mess with young girls, no matter what your mindset, you're in trouble.

Uh, so in other words, you think it's a great idea that a girl who looks like she could be of legal age can purposely deceive someone older than them, entice them into having sex, and then have them sent to jail?

Sorry, but this girl isn't a victim. She purposely lied about her age to lure an older man into a situation where she had power over him. She has a history of this, like the article says.. this is the SECOND man in jail because they've had sex with her after she lied to them about her age.

I can't believe you would think that the girl lying isn't a valid defense, that's so fucking ridiculous. She purposely lied about her age, why wouldn't it be a valid defense?

When he found out, he went to her father and let him know what had happened, presumably to ensure that the father kept her under a shorter leash so she wouldn't do it again.

It wasn't ignorance on his part, it was deception on hers.

It's not like it's difficult to have a fake ID made.. Many of my friends had them when I was growing up, it's not like this girl, who apparently spends her time at bars and stays out late at night without parental supervision is incapable of getting one

The line needs to be drawn somewhere.

Think of the alternative...

If deception is a defense, we will have 13 year old girls on the stand testifying as to whether they were lying or not. More often than not these girls are going to have feelings for the older guys and want to protect them or even worse, be in fear of the older attackers.

Again, I sympathize with this guy's case, but I don't think it demands a change as to where the line is drawn.

And why shouldn't they be on the stand when a persons liberty is at stake?

I don't care if they're 13, if some whore lies about their age to seduce an older man, the man isn't responsible for her deception, she is.. She has done this before, why shouldn't she be on the stand to answer for her actions?

There's provable deception here, how can you say the man should be held accountable for breaking a law he was under the impression wasn't relevant to their encounter?

I'm thinking of THIS case. In THIS case it's pretty obvious she was lying, so THIS time in THIS case THIS guy shouldn't be going to jail.

In fact, her FATHER should be investigated for contributing to the delinquency of a minor.

Because the law states it doesn't matter what he was thinking. It's a strict liability offense - kinda like speeding. It doesn't matter what you were thinking when you are driving 75 in a 55 zone, if you're driving 75 you're guilty. Sure the penalties are greater for statutory rape, but it's not like this is a new or unique law - people understand that if you mess with young girls, you're liable to get in trouble.

It's stuff like this that has lead Ireland to rule statutory rape laws unconstitutional.. We should follow suit here, you should always be afforded the ability to defend yourself without automatically being guilty of a crime regardless of the circumstances

I think it should matter what he was thinking if he was lied to about the age. If he was purposely deceived into believing she was of legal age, how can he be held responsible for not being able to see past her deception?

It's complete bullshit

if she murdered someone there would be a hearing to decide if she can be tried as an adult.

why can't there be a hearing to determine if she can be considered an adult in this case?
