No you quote a section dealing with citizens being put on trial.

We are talking about an accused fighter being held. If he is accused of a crime, he has those rights to see the evidence get a lawyer etc....

Since he was nonviolent, they have to accuse him and prove that he was aiding the enemy. That is in the GC, and I keep quoting the civilian section because it outlines who is NOT a civilian, and he didn't fall into any of those categories without accusation and proof (though, while being held, I'd take even an accusation to be them trying to follow the rules)

nonviolence has nothing to do with it, if you are traveling with the military you are considered a POW. End of story. If the 101st was overrun because Geraldo's bullshit, he would be held as a POW.

They are not holding him even as a POW though, that is a large part of the problem.

I never said he was guilty of anything. I asked what makes him better than any other person we're holding in Iraq? Just because AP gives him a paycheck doesn't make him any better than the rest of people we've arrested Iraq after being caught in the same position he was in.

This is a guy who takes propaganda photos for the AP. He was arrested in a militant safehouse which stored weapons to use against US troops. He was found with explosive traces on him. He takes pictures of terrorists assassinating US sympathizers. He's nothing other than a puppet to the terrorists to send out images to the Americans.

He was captured 5 months ago and AP sat on the story and then attempted a coverup. This is getting insane. His photos were obviously staged

To your completely dodging question: What makes him different is that he is not some random Ali Hakim or Iraqi citizen or something...here is a case where we actually have an organization that is standing up for him because they know who he is...how many others have been whisked away and we don't know if their dead, tortured, jailed, etc

Here is the one example, and we can show how broken the system is
