Promoting a war you disagree with or telling a one sided story doesn't make him a criminal.

You have to break a law in order to be a criminal.

Proving he broke the law is nearly impossible though as the wording is fairly vague. But there are federal statutes on the books to prohibit such "conflicts of interest."
