Why wouldn't they? Statutory damages means automatic damages, and all you have to prove is that youtube distributed your video without permission. I'm not sure whether the fact that the user, not google, put up the video has any legal bearing.

I dunno, but Marc Cuban was of the opinion that anyone who bought youtube was "an idiot" because it'd be a copyright infringement disaster.

Then again, I'm sure Google has some good lawyers who wouldn't let them jump into a disaster. It'll be interesting to see how it turns out.

An interesting question on who is responsible for content if someone violates the terms of service.

Another reason they may not sue is possibility of using Youtube in a positive way.

Another point is that YouTube has been doing this for quite some time

If I rent time on CBS for a late-night infomercial and instead use it to broadcast re-runs of the '01 world series, CBS is just as liable as me for that broadcast.

Youtube (now google) is allowing their site to be used for rebroadcast of copyrighted materials. They are responsible for removing/preventing it.

Sure, tv/movie producers/owners can partner with google/youtube but that doesn't mean google/youtube isn't breaking a copyright law today.

If you break the law for a long time it doesn't change the fact that you're breaking the law.

It's interesting as web hosting providers are not liable for content (though they must comly with takedowns).

I don't disagree. It just may not be in the interest of the content holders to sue. They may be able to work out some other form of compensation
