NEW YORK (AP) -- A firebrand civil rights lawyer who has defended Black Panthers and anti-war radicals was sentenced Monday to nearly 2-1/2 years in prison or helping an imprisoned terrorist sheik communicate with his followers on the outside.
The sentence, handed down at the end of a lengthy hearing, was far less than the 30 years prosecutors wanted.
Lynne Stewart, 67, smiled, cried and hugged supporters after U.S. District Judge John G. Koeltl pronounced sentence.
The judge said Stewart was guilty of smuggling messages between the sheik and his followers that could have "potentially lethal consequences." He called the crimes "extraordinarily severe criminal conduct."
But in departing from federal guidelines that called for 30 years behind bars, he cited Stewart's more than three decades of dedication to poor, disadvantaged and unpopular clients.
"Ms. Stewart performed a public service, not only to her clients, but to the nation," Koeltl said.
The judge said Stewart could remain free while she appeals, a process that could take more than a year.
Stewart was diagnosed with breast cancer last year, and her lawyer Elizabeth Fink had warned in a plea to the judge: "If you send her to prison, she's going to die. It's as simple as that."
Outside court, Stewart said she thought the sentence was "a victory for doing good work all one's life." She added: "You get time off for good behavior usually at the end of your prison term. I got it at the beginning."
U.S. Attorney Michael Garcia had no immediate comment.
Stewart has represented Black Panthers, leaders of the 1960s student activist group Weather Underground, a former mob hit man and a man accused of trying to kill nine police officers.
Stewart was convicted in 2005 of providing material support to terrorists. She had released a statement issued by one of her clients, Omar Abdel-Rahman, a blind sheik sentenced to life in prison for plotting to blow up five New York landmarks and assassinate Egypt's president.
Prosecutors have called the case a major victory in the war on terrorism. They said Stewart and other defendants carried messages between the sheik and top members of an Egypt-based terrorist organization, helping spread Abdel-Rahman's call to kill those who did not subscribe to his extremist interpretation of Islamic law.
Stewart was arrested six months after the September 11 attacks, along with Mohamed Yousry, an Arabic interpreter, and Ahmed Abdel Sattar, a U.S. postal worker.
Yousry was sentenced to one year and eight months behind bars, while Sattar received 24 years in prison Monday.
Convicted of conspiracy to kill and kidnap people in a foreign country, Sattar could have gotten a life sentence. But the judge said no one was killed or injured, and he cited Sattar's lack of previous crimes and his restrictive prison conditions.
In a letter to the judge, Stewart proclaimed: "I am not a traitor." She said she did not intentionally enter into any conspiracy to help a terrorist organization.
"The end of my career truly is like a sword in my side," Stewart said at her sentencing. "Permit me to live out the rest of my life productively, lovingly, righteously."
In court papers, prosecutors said Stewart's "egregious, flagrant abuse of her profession, abuse that amounted to material support to a terrorist group, deserves to be severely punished."
Earlier, about 150 Stewart supporters who could not get inside the filled-to-capacity courtroom stood outside the courthouse, chanting "Free Lynne, Free Lynne."
"It's not just Lynne Stewart who is a victim; it's the Bill of Rights that's the victim," said Al Dorfman, 72, a retired lawyer.
About 200 more supporters jammed the halls outside the courtroom.
This is ridiculous. She should be hanged. People are dead because of her. And she gets off with a slap on the wrist? Why? Maybe in part because of her multi-million dollar defense funded by George Soros.

I think it was because she has cancer or had recently, and she is 67. Someone like that will die in prison if they are there for more than a couple years.
But I'm not sure, given her actions, why death was not the sentance given to her/

Yea, I don't care about her sickness, that's not the concern of our nation or justice. She deserves punishment for her actions. If she dies in prison, so be it. It's not our fault she's a traitor, why shouldn't she be properly punished? I don't see how her medical conditions should have meant anything.

I'm tired of hearing the argument for rapists, murderers, traitors, etc that "they have cancer, don't put them in jail." Don't be a criminal and you won't have to worry about it. It doesn't fly with me, no sympathy for them here. The only people I have sympathy for are the familes of the people dead because of her.

Well you have to remember, only Republicans and Christians are expected to have personal accountability and morals. Everyone else is a lost cause, so we can't expect anything of any worth from them.

the punishment should fit the crime, irregardless of her health. Death sentences are handed out in courts all the time

This woman is a terrorist. She supports terroristism and has made a career out of defending them. She aided them in killing over 100 people in Egypt. She deserves to die for her crimes. George Soros is a peice of shit for spending millions defending her.

In any case I wouldn't support the death penalty (I oppose in virtually all cases) as it isn't really a penalty at all.

As for funding her legal costs, last I checked that wasn't illegal.

She was the defense attorney for the people who bombed the World Trade Center in 1993. She passed along messages to his fellow terrorists so that her "client" could orchestrate the deaths of over 100 people while on trial and behind bars in America.

No it's not illegal, but it makes you a complete peice of shit. It's one thing for the ACLU to defend someone who can't get proper legal defense. It's another if you're a big time businessman with huge political standing to defend her. Soros defended her because she was radically left.. just like him.

I agree that seems likely. I don't see what he did as really being a bad thing, but only because of the way the legal system works

Other articles are more clear on it. She personally hand delivered messages that resulted in the bombings of Egyptian vacation resorts.

She delivered a message and:

just after his followers in Egypt had opened fire on tourists at the Temple of Hatshepsut in Luxor, killing 58 foreigners and 4 Egyptians. Subsequently, high-casualty Islamist terrorism resumed in Egypt on October 7, 2004, with a series of bombings that killed 34 in and around the Egyptian Sinai resort of Taba. On July 23, 2005, three bombs exploded in the Red Sea resort of Sharm el-Sheikh, killing at least 64.
The prosecutor says:
The prosecutor argued, citing a letter written by the U.S. attorney's office to Stewart after she delivered the message to Reuters, that it was not in the sheikh's legal rights "to pass messages which, simply put, can get people killed and buildings blown up." They argued that the case was equivalent to a "jail break," in which the defendants extracted Abdel Rahman from prison, "not literally, of course, [but] figuratively, in order to make him available to other terrorists."

yes it was intentional, she said she wanted to "establish her client in egyptian politics"
