Honestly, I think she should have been charged with murder. At that point the child was a child. It was fully developed and capable of surviving outside of the womb without any outside help. It was a living, breating, mentally aware person. She knew it and she shot the baby. What if the baby had moved 6 inches down the vaginal canal? would it have been murder then?

Your bad... I define "sentencing" as "one of two things happened." And if you disagree that I believe "sentencing" means "one of two things happened" then you're going to have to get in my brain and prove that's not what I thought it meant.

it's not a baby until it breathes and isn't attached by an umbilical cord.... or unless someone not the mother or a legal doctor kills it

for certain a crime was committed. But I see no benefit in locking her up, other than for her own. It's not like she's at much of a risk to shoot anyone else in the stomach, and I don't think we need to send a message that shooting yourself in the stomach is a bad idea. Her actions are deplorable, but paying for her to be in a cell would make about as much sense as paying for a person who tried to commit suicide in a cell, for that too is a crime.

I *HATE* my neighbor. I've never hated anyone else in my life, but I *HATE* him. I dream about hurting him and I usually wake up laughing. I've never wanted to hurt or kill anyone else, just him. I've told family and friends if I meet him and nobody else is around I'm going to kill him. A few times I've waited by the corner to see if he'd come by walking his dog. So far he hasn't, but one of these days he will and I'll get him.

When I finally kill him and someone posts on this board "7960 killed his neighbor

No because locking you up with discourage others from killing their neighbors.

Because it's her fetus which is living off of, and inside of, her body. It's like a quasi body part of hers. We're allowed to do plenty of stuff with our own bodies that nobody else can.

The law says "makes a criminal out of 'any person [to] administer to, or cause … any drug or other thing' with intent to destroy an unborn child."

To say the law should have said "any person, including the mother..." would open more doors. Why doesn't it say "any person, including the mother or father..." or "any person, including the mother, father, or grandparents..." or "any person, including the mother, father, grandparents, or cashier at the local Piggly Wiggly..."

Putting a qualifier on it means you have to define all possibilities. Saying "any person" means "any person"...it means me, you, the mother...*any* person. To qualify it by adding "including the mother" means you'd have to add every other person. If you leave off any person then that person is excluded from the law.
