5th Circuit Court: DeLay's name MUST remain on ballot!

NEW ORLEANS -- A federal appeals court on Thursday refused to let Texas Republicans replace Tom DeLay's name on the November congressional ballot.

The 5th U.S. Circuit Court of Appeals upheld a ruling by U.S. District Judge Sam Sparks, who said in July that DeLay's name had to stay on the ballot even though he quit Congress and moved to Virginia.

He won the primary, and his claim of "i cant run now, ill be in Virginia" isn't enough

in case you are wondering, no there are no other excuses he could use

only an appeal to the SC, but the 5th CC is notoriously more conservative than other CCs, so a SC appeal would almost certainly get him either no hearing or a disfavorable one

His excuse on hannity and colmes last night was "well i guess the liberals don't want to give the voters a choice"

Because they can now only vote in a Democrat. He dropped out of office and moved to another state. Even if he wins it'll be like voting in the dead guy and the runner up gets the position.

woiuldn't it be more pertinent to ask if it was the liberals who partook in all of his shady dealings? wtf, ballz? is he responsible for his actions, or are liberals?

2) The court that just backed up this ruling is the same court that was so conservative it was the only court to ever even suggest the 2nd amendment gave an individual right

I'm glad its not, you see Iraq lately? I wouldn't want to be in charge of that shit

The only downside to Dems not having power is:
1) Lack of ability to launch investigations against the President
2) Lack of ability to control judicial nominations

Otherwise, I love seeing them in power so their policies fail to the point that they give up and become more liberal, or bicker and fall apart

I mean really, who can say a liberal's life is so much worse now in 2006 than it was in 1993? They have been the do-nothing revolution

On the other hand...conservatives can expect some revenge if the Dems win in 2006

yeah he's responsible for his actions. which is why he also stepped down, and it seems he doesn't want to be on the ballot. not to mention, has he been indicted for his accusations? was he acquitted? what came of that? is he guilty or not?

if it's the liberals that are taking this to court, then perhaps he is right when he says it's the liberals that are doing this to keep the voters from having another choice

the voters had a choice, they voted for DeLay in the primary

They still have a choice. Nothing is keeping anyone else from getting their name on the ballot as an Independent, etc, as I understand it. DeLay could even campaign for them!

However, the Republican primary has already been held and DeLay was the choice of the voters. The court is saying he can't withdraw his name as the Republican nominee.
