gonzales: there is no express grant of habeas corpus in constitution

GONZALES: I will go back and look at it. The fact that the Constitution — again, there is no express grant of habeas in the Constitution. There is a prohibition against taking it away. But it’s never been the case, and I’m not a Supreme —

SPECTER: Now, wait a minute. Wait a minute. The constitution says you can’t take it away, except in the case of rebellion or invasion. Doesn’t that mean you have the right of habeas corpus, unless there is an invasion or rebellion?

GONZALES: I meant by that comment, the Constitution doesn’t say, “Every individual in the United States or every citizen is hereby granted or assured the right to habeas.” It doesn’t say that. It simply says the right of habeas corpus shall not be suspended except by —

SPECTER: You may be treading on your interdiction and violating common sense, Mr. Attorney General.

GONZALES: Um.

'um' is right...

Article 9.
The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.
some may argue it was a slip of the tongue, but christ, he said it twice. talk about playing with words. if its not granted, how can we speak of it being suspended?

this is another clear example of the administration wanting to be above the constitutiuon.

Amazing. This is right up there with John Yoo saying the president can crush children's testicles if he wants to. Gonzalez is easily one of the worst Uncle Toms of this administration.

He has a job because apparently the president believes he has the authority to crush the testicles of a child.

Here is the audio.

This is no surprise. I would love to see the entire Bush administration placed in Gitmo indefinitely and subjected to "harsh interrogations".

I just don't understand how Americans could support an administration that says things like this. I'm not saying the other Republicrats are any better but it's clear no one who values their personal rights should be supporting any of these political elites. Time to get some fresh blood in there and kick the aristocracy out.

1) most people don't watch C-SPAN
2) most that understand what's going on don't approve
3) people are more concerned about themselves only

Wow.

I watched the replaying of the hearing today in front of the Judiciary Committee.. it was pretty amazing.. though sad.

I just can't believe they have such a blatant disregard for Congressional authority, oversight, intent, etc.. and they admit it! Gonzales essentially admitted that yeah, they could have done it through FISA, but said that they still essentially don't have to, because the President has the authority to wiretap whoever he wants

I hate when people try to reinvent or bend the constitution to meet their superficial needs. I'm glad Specter let him have it in the end. We shouldn't tolerate that kind of behavior.

If you caught the whole thing, there were troubling issues, such as implementing temporary positions indifinately that should actually go before Senate confirmation.
