I called one attorney's office and they referred me to another office since they didn't take those type of cases. That other office called me the other day, but I have yet to call them back.

That's sorta the status of everything right now.

Sorry to hear that....I can't imagine that kind of trauma

I'm really not trying to start anything but why would they be liable? No guard, broken lock...?

We're not sure if they are. We only think they may be because of a couple different reasons:


1. Hardees had a drop safe but did not use it. They used a regular combo lock that my sister knew. So, another coworker there comes in after hours, forces her to open the safe by knifepoint and then rapes her. We think if they would have used a regular drop safe, this could have been avoided?

2. Most restaurants have policy of having at least 2 - 3 people to close. My sister was there by herself and had closed by herself a couple times before.

3. Guy was an ex-con and while I support ex-cons getting jobs, maybe a better screening process could have prevented this or something? I dunno.


Hardees was also generally shitty towards my sister, and I just found out, that they would force her to clock out at 10:30 (she was under 18 a few months ago) because of a state law, but then would force her to continue working. Other workers they did not do this too. They treated her like shit, and my sister is stupid for continuing to work there.

We don't know if they are liable for anything, but we think they may be?

I saw this thing about some guy who pretended to be a police officer, walked into a McDonald's, accused this chick of stuff and talked the manager into allowing him to "interrogate" her at the restaurant, then took her in a back room where the manager left them alone together (the girl was 16) and the guy had her do all kinds of sick stuff including getting naked and spanking her and shit.

Shit like that is so fucked up. I don't see how managers can let young girls like that (and lew's sister) be left alone and suceptable to this crap.

I didn't realize they had a drop safe and weren't using it. That's fucked up. It seems like they'd be at least partially responsible for it.

As for the two people thing, their defense could say that if it were your sister and the guy closing together, the same thing would have happened. It's a bit of a stretch, but I think their defense could weasel it in there.


Anyway, I'll stop yappin' about it. I figure you probably deleted your other thread for a reason. My condolences, lew.

No, the guy who pretended to a cop told the manager to strip search her, which she agreed to and also I believe a vaginal cavity search, then had a male employee walk in, he took the phone, and the guy on the phone told her to give him oral sex...naked, which she agreed to, then eventually he hung up and she went to the police afterwards

Also, I believe McDonalds was not held liable for the conduct of their employees

I believe there are strong rules made by corporations to protect inter-employee disputes from affecting their profits, both in company policy and in corporate law

In the end, your sister agreed to work there knowing the problems and if she doesn't have letters she sent to management about problems she is remembering now then she has no history of complaints and she doesn't have a lot of legal ground to stand on...

Check your local and federal statutes, but you have to prove foreseeability in a court of law, among several other issues, I don't even see foreseeability by the corporation that their actions would lead to an employee being raped

the theory that the corp put a known convict in a position to do the harm he did is not too far out there. It's an extremely fact-specific argument and will depend on how the courts in the state treated such cases in the past.
